ARTICLE 1: OBJECT
Brittany Food Tour has in particular the sale of food tours (gourmet walking tours) to allow customers to discover the city of Lorient, Groix, and other areas of the country of Lorient, the city of Vannes and Auray and areas, as well as Brest and the country of Brest and their gastronomy and the know-how of their artisans and producers.

ARTICLE 5: CHARACTERISTICS - CONFORMITY
Bretagne Food Tour may modify at any time the range of products and services offered for sale on its Website, without prejudice to reservations made by the Customer.

In accordance with article L. 111-1 of the Consumer Code, the Customer may, prior to his reservation, read, on the Bretagne Food Tour Website, the essential characteristics of the services and/or product(s). that he wishes to reserve. The products included in the gourmet tour are not known to the Customer prior to their reservation. The Customer is fully aware of and fully accepts the characteristics of this service.

ARTICLE 6: AVAILABILITY
The offers presented by Bretagne Food Tour are valid as long as they are announced on the site and within the limit of available places but it is preferable to make the reservation at least 72 hours in advance. After this period, Bretagne Food Tour cannot guarantee the reservation.
In the event of unavailability of one or more products or services after making the reservation, the customer will be notified by e-mail. The amount of their reservation will be recalculated and the Customer will be debited with the new amount, reduced by the missing products. If the reservation is completely unavailable, the customer will be notified by email, SMS or telephone call no later than 2 hours before the start of the food tour and will not be charged or will be refunded in full. In this case, Bretagne Food Tour cannot be held responsible for any damage suffered by the customer, nor liable for any damages.
ARTICLE 7: RESERVATIONS

• 7.1: Reservation of a gourmet stroll or a gift voucher for a gourmet stroll
When the Customer confirms his reservation by clicking on the “I accept the general terms and conditions and reservations” button, he is considered to have knowingly accepted the content and conditions of the reservation in question and in particular these General Conditions of Sale. .
Bretagne Food Tour will then confirm this reservation by sending an email to the Customer.
In addition, Bretagne Food Tour reserves the right to suspend or cancel any execution of a reservation, whatever its nature and level of execution in the event of non-payment or partial payment of any sum which may be due by the Customer, in the event of a payment incident, or in the event of fraud or attempted fraud relating to the use of the Bretagne Food Tour Website, including in the event of previous reservations.
Also, in the event of an error in entering the electronic mail address concerned, or non-receipt of the electronic reservation confirmation message, Bretagne Food Tour cannot be held responsible. In this case the sale will be considered final, excluding cases of cancellation of the reservation by Bretagne Food Tour, in particular due to unavailability of the products. Bretagne Food Tour reserves the right to suspend or cancel any execution of a reservation, whatever its nature and level of execution in the event of bad weather conditions or unexpected sick leave of the guide.
• 7.2: “It’s my turn” reservation (personalized ride)
The reservation of a service is only firm and final after written acceptance by the customer and signature (by mail or email) and after payment of the entire service, of the amount indicated on the quote.

ARTICLE 8: PRICES FOR SERVICES AND PRODUCTS FOR SALE ON THE SITE
The sales prices of the services and products appearing on the Site are indicated in Euros, all taxes included, it being understood that the reserved products are invoiced at the prices and taxes in force when the reservation is made.
The sales prices of services and products may be modified by Bretagne Food Tour at any time and the modification will then be notified to the Customer before any reservation.
ARTICLE 9: PAYMENT
All food tour reservations are payable in euros.
Payment for services is made:

• either by credit card in the case of an online reservation
In order to optimize the security of transactions, any payment made by credit card on the Bretagne Food Tour Site is made via the secure online payment system called Stripe, which makes it possible to encrypt all data relating to orders (including names , addresses and credit card numbers) so that the information communicated is protected during its transmission.
The Client guarantees to Bretagne Food Tour that he is fully authorized to use the payment card for the payment of his reservation and that these means of payment legally give access to sufficient funds to cover all costs resulting from his reservation on the site www.bretagnefoodtour.fr Bretagne Food Tour cannot be held responsible for any fraudulent use of the payment method used.

Bretagne Food Tour reserves the right to suspend or cancel any reservation, whatever its nature and level of execution, in the event of non-payment of any sum due by the Client or in the event of a payment incident. .
Penalties of an amount equal to the legal interest rate increased by five points are automatically applicable to unpaid amounts after a period of ten days following the scheduled payment date or upon notification of bank payment rejection. for any other means of payment.
Any new reservation may be suspended in the event of late payment for a previous reservation, notwithstanding the provisions herein.
It is up to the Customer to save and print their payment certificate if they wish to keep the banking details relating to their transaction.
The food tours of Groix, Lorient and Vannes are on foot. The customer pays for their transport to get there to the meeting place.
The Brest food tours are transported with the Brest city Tour, in partnership with its associated travel agency Les Abers.
ARTICLE 10: CANCELLATION BY THE CUSTOMER
• 10.1: Gift voucher (for one of the gourmet walks)
Valid for 1 year from the date of purchase, it is non-modifiable and non-refundable and no extension can be granted.
• 10.2: Food tours involve a specific date, raw materials prepared by local producers or reserved visits…
For one of the food tours (gourmet walks)Purchases are firm and final. They cannot give rise to reimbursement or the exercise of a right of withdrawal. Article L.121-21-812° of the Consumer Code provides that the right of withdrawal cannot be exercised for contracts relating to leisure activities to be provided on a specific date or period. The organizer will not reimburse a participant who does not show up on the day of the activity.
Any changes to the order by the customer after confirmation of their reservation are subject to acceptance by Bretagne Food Tour (e.g. adding a person, etc.)
For walks in Lorient, Groix, Vannes, they are insured for a minimum of 5 (Lorient Vannes) or 6 people (Groix) and a maximum of 12 people. For Brest rides with the double-decker bus, they are provided with a minimum of 24 people and a maximum of 30 people. For the Lorient sunset culinary cruise, for the moment it is reserved for groups. The minimum number of people for the group is 20 people to 25 people.
If these minimums are not reached we reserve the right to operate the ride or postpone it to a later date.
The Groix Food tour takes place on the island of Groix. It is accessible to people already on the island, or to people on the mainland. In this case, the crossing takes place with either the old Korriganez rig (July and August), or with the regular Cie of your choice. Transport is independent of the food tour. It is your responsibility to pay this to the transport company. For information, If you choose the old rig, the captain of the old rig is the sole sovereign to decide if the crossing is feasible in complete safety for the clients, or if he must cancel the navigation for technical or weather reasons. In this case, you can make the crossing with regular companies (Océane, Escal Ouest, Laita Cruise, etc.).
The customer is aware that Bretagne Food tour cannot in any way be held responsible for this hazard beyond their control and that this cannot be a reason for cancellation of the Food tour, the producers having organized to welcome us with their side on the island.

• 10.3: “It’s my Tour” (personalized ride)
The Customer may partially or totally cancel their personalized reservation, under the following conditions:
Any cancellation must be notified in writing, the date of receipt of the cancellation will be taken into account for the application of the cancellation fees provided for below.
• For a cancellation more than 30 calendar days before the scheduled date, a penalty representing 15% of the price of the service is due by the Customer, regardless of the amount of the service.
• For a cancellation between D-30 and D-10 calendar days before the scheduled date, a penalty representing 40% of the price of the service is due by the Customer, regardless of the amount of the service.
• For a cancellation made less than 8 (eight) calendar days before the date of the service or non-presentation of the Client on the day: a penalty representing 100% of the price of the service is due by the Client.
ARTICLE 11: CANCELLATION BY THE ORGANIZER: BRETAGNE FOOD TOUR
In the event :
• exceptional unavailability of the attendant,
• a case of force majeure: weather conditions (orange or red alert), and in particular storms making the boat crossing impossible, major event in public space (demonstration, etc.) which do not allow the activity to be carried out in adequate safety conditions. If the crossing cannot be done with the old rigging over the water, for weather or technical reasons, the crossing will be made with the regular Lorient-Groix company, in the event that it is too late to cancel the producers of the island. (- 5 days).
Bretagne Food Tour reserves the right to cancel the services ordered and possibly postpone them.
Participants will be informed by email, not SMS or by phone call as soon as possible.
Any cancellation by the organizer will result in the reimbursement of all sums paid by the customer, without the customer being able to claim any damage.
Bretagne Food Tour reserves the right to end a trip if, through the behavior of a customer, the rules of decency and safety are not respected.
On the scheduled date of the visit, if Bretagne Food Tour finds itself obliged to change the meeting time and place, it will notify participants by email, SMS or telephone call as soon as possible.
Please note: rain or snow does not prevent the organization of walks except in cases of force majeure (see above).
ARTICLE 12: INTELLECTUAL PROPERTY
All elements reproduced on www.bretagnefoodtour.com and in particular, but not exclusively, the texts, comments, works, illustrations, images and brands are protected under intellectual property. Any total or partial reproduction of the elements accessible on the site is strictly prohibited.

The liability of Bretagne Food Tour under the obligations of these General Conditions of Sale cannot be incurred in the event that the non-performance of its obligations is attributable to the act of a third party even if it is foreseeable, to the fault of the Customer , or upon the occurrence of a force majeure event as defined by the French courts or any other event which was not reasonably under the exclusive control of Bretagne Food Tour.

• 15.2: Customer responsibility
The customer must arrive at the location 15 minutes before the meeting time specified on their reservation.
Transport costs to the meeting point are their responsibility. The price includes the ride and the tastings. The price does not include personal expenses and special requests.
The participant is free to interrupt or leave the ride at any time, he will not be able to claim any refund or reduction of any kind.
People with travel difficulties or/and people with reduced mobility are invited to check with Bretagne Food Tour that the visit is adapted to their capacity.
In the event of a food ban, the customer must inform Bretagne Food Tour when booking.
In the event of damage during a trip, Bretagne Food Tour reserves the right to request compensation. The customer must take advantage of civil liability insurance which may be incurred in the event of damage.
The customer must respect the rules of safety and caution during the walking tour. Bretagne Food Tour declines all responsibility for accidents along the way.
